Understanding points on license for speeding tickets in NY

The “point system” is a method which the DMV uses to assess the value of driving offenses and to punish drivers for repetitive behavior which, individually, may not be considered serious enough to merit a license suspension. New York State Vehicle and Traffic Law § 510(2) allows the Commissioner to suspend or revoke a license or registration or permission to drive for habitual or persistent violation of the Vehicle and Traffic Law “VTL,” or of local rules in relation to traffic. Points are added for each offense even if committed the same day by behavior arising out of the same events.    

While the New York DMV does not add points for out of state convictions, out of state alcohol or drug related offenses result in an automatic six months revocation.  Moving violations committed in Ontario or Quebec will result in points. The failure to pay out of state tickets or fines in most states will result in a reciprocal suspension of New York driving privileges until paid.   In most cases, if you commit an out of state traffic violation and are convicted, points are not added to your New York State driver’s record.          

Points may be subtracted from a driver’s record as well.  To do so, a driver must attend a motor vehicle accident prevention course approved by the Commissioner of the DMV.  Successful completion of the course will result in up to 4 points being subtracted from the driver’s record. Credit will not affect a suspension or revocation which has occurred before notice of the completion of the course.  A client who is charged with an offense which will boost their point total to 11 or more within an 18 month period should complete the course immediately and attempt to complete it prior to conviction and sentence. The Commissioner’s criteria for attendance is presently the accumulation of more than 7, but less than 10 points, in an 18 month period.  No person can receive a point reduction more than once within an 18 month period, and the course is not available for points accumulated as a result of 3 speeding convictions within an 18 month period.

A guilty plea to one speeding ticket may result in the imposition of the DRA if the points assessed are 6 or more! Assessments are assessed for:

An alcohol related traffic violation ($250.00 per year);

Refusing a chemical test for alcohol ($250.00 per year);

Receiving six points on a driver’s record within 18 months ($100.00) per year); then $25 per point for each point above six points.  Failure to pay within 30 days will result in a suspension of the driver’s license, permit or privilege until paid. The date of the offense is used to determine the starting date of the 18-month period, not the date of conviction.  Completion of a DMV approved accident prevention course will not affect the liability to pay the DRA, although it will reduce points and insurance premiums.
